Important changes to immigration ruling - Update

09-Dec-2009

Ruling

We have this afternoon received Department of Health advice stating that non-UK / non-EEA doctors who are classed as UK graduates - i.e. are graduates of medical schools in the UK, and are currently undertaking UK Foundation training - will be eligible to apply for UKBA Tier 1 Post-Study Work Visas.

Therefore, these candidates will not be subject to the Resident Labour Market Test. This means that candidates in this category who meet the necessary criteria will be eligible to apply in Round 1 of CMT recruitment - i.e. the round of recruitment which is currently running.

For more information on the post-study work visa, please visit this page of the UK Borders Agency website: http://www.ukba.homeoffice.gov.uk/workingintheuk/tier1/poststudy/

Applying

We have produced a guidance document for applicants under this category who wish to apply to CMT in Round 1. This is in the form of a document which can be downloaded from the Downloads page of our website (Item #10).

The CMT Recruitment Team here would like to stress that this information has been disseminated to us directly from the Department of Health, working in conjunction with the UK Borders Agency. We are not able to provide further interpretation of this ruling, nor any others in relation to immigration / visa status.

While we are keen to provide assistance where we can, the complexities involved in immigration and visa issues are such that advice and guidance in these areas should be provided by DH and UKBA staff who possess the specific skills, experience and knowledge required to advise as necessary.
